Terms & Disclaimer of Liability

Overberg Activities is an independent booking agent based in Hermanus, South Africa. We curate and re-sell day-experience products operated by qualified third-party operators around the Overberg, Walker Bay and Hottentots-Holland regions. By making a booking through this website, by phone or via the Arabella Hotel & Spa concierge, you confirm that you have read, understood and accepted these terms in full — including the Disclaimer of Liability set out in section 7.

A booking is only confirmed once full payment has been received and you have received an email confirmation containing a reference beginning OA-. We act as an authorised agent for each activity operator listed; the underlying contract for the activity itself is between you (the guest) and the operator. Where any conflict arises between these terms and the operator's own conditions, the operator's safety, capacity and age restrictions prevail.

All prices are quoted in South African Rand (ZAR), per guest, and include VAT where applicable. Payments are processed securely by Stripe; we do not see or store your full card details. Card surcharges, foreign-exchange fees and dynamic-currency-conversion costs applied by your card issuer are your responsibility.

• By you, more than 48 hours before departure: free date change subject to availability, or refund less a 10% admin fee.
• By you, 24–48 hours before departure: one free date change subject to availability. Cancellations are non-refundable.
• By you, less than 24 hours before departure or no-show:non-refundable, non-transferable.
• By the operator (weather, sea state, mechanical, force majeure):we will offer you the next available departure or a full refund of monies paid to us. We are not liable for connecting travel, accommodation or other out-of-pocket costs arising from such a change.

Date and guest-count changes can be made from the Manage booking page using your reference and email.

Several activities involve physical exertion, heights, water, animals or remote terrain. You agree that you (and every guest in your party) are in good general health, are not pregnant, do not suffer from heart, back, neck, joint or balance conditions that would make participation unsafe, and are not under the influence of alcohol or non-prescribed substances at the time of the activity. You must declare any relevant medical condition, allergy, dietary requirement or mobility limitation at the time of booking, in the special-requirements field, or by emailing us prior to departure. Operators reserve the absolute right to refuse participation on safety grounds, in which case section 4's no-show policy applies.

Minimum age and maximum weight limits are set by each operator and are shown on the activity page. Children under 18 must be accompanied by a parent or guardian who accepts these terms on their behalf. Photographic ID may be requested at check-in.

Read this section carefully. By making a booking you accept it on behalf of yourself and every guest in your party.

Adventure, nature and water-based activities are inherently risky. You acknowledge that participation in any activity booked through Overberg Activities — including but not limited to horse riding, zip-lining, hiking, sea kayaking, boat-based whale watching, wine tasting and road transfer — carries a risk of personal injury, illness, emotional distress, property loss or damage, and, in rare cases, death. You participate voluntarily and at your own risk.

To the fullest extent permitted by South African law (including the Consumer Protection Act 68 of 2008), Overberg Activities (Pty) Ltd, its directors, members, employees, agents, partners and the activity operators we represent shall not be liable for any direct, indirect, incidental, special, consequential, punitive or pure-economic loss or damage — including loss of life, bodily injury, illness, loss of or damage to luggage, electronics, jewellery or other personal property, missed connections, missed accommodation, additional transport or any other out-of-pocket expense — arising from or in connection with any activity, transfer or service, save where such loss is caused directly by our gross negligence or wilful misconduct.

You agree to indemnify and hold Overberg Activities and its operators harmless from any claim brought by you, your estate, your dependants or any third party arising from your participation, save as above. Where the law requires it, certain liability cannot be excluded; in those cases the limitation above applies only to the maximum extent permitted.

You are strongly advised to hold valid comprehensive travel insurance covering adventure activities, medical evacuation and trip cancellation for the full duration of your stay. Overberg Activities does not provide insurance and accepts no responsibility for arranging cover on your behalf.

Operators may take photographs or video of activities for safety, marketing or social-media use. If you do not wish to appear, please tell your guide at check-in and we will do our best to accommodate you. Any imagery you receive from us remains the copyright of the respective operator.

We collect only the booking information you provide (name, email, phone, special requirements, guest count) and the minimum payment metadata returned by Stripe. We share booking details with the relevant operator strictly for the purpose of running your activity. We do not sell your data and we do not market to you without your explicit consent.

These terms are governed by the laws of the Republic of South Africa. Any dispute will be referred first to good-faith mediation and, failing that, to the exclusive jurisdiction of the Western Cape High Court, Cape Town.
